Mississippi Attorneys Representing Victims of Drunk Driving Accidents

Providing clients with compassionate and trusted legal care since 1926

Driving while under the influence of drugs or alcohol is illegal and dangerous. Alcohol slows reaction time, blurs vision and causes drowsiness and unpredictable behavior. Corban • Gunn • Van Cleave Law Firm is committed to determining who is to blame for your drunk driving accident. We recognize that you may have suffered significant injury or possibly lost a loved one at the hands of a drunk driver. We aggressively pursue damages from the liable party or parties, offering you personalized and compassionate guidance along the way. Our office is located in Biloxi, MS, and we are dedicated to serving injury victims on the Gulf Coast and across the state.

Filing a civil lawsuit

Drunk driving violates the law. The person who caused your injury likely faces criminal charges. However, you may file a separate civil case. By doing so, you may be able to obtain compensation for pain and suffering, medical expenses, and lost wages. Yet before you file a claim, you should consult with a reputable attorney. Our lawyers at Corban • Gunn • Van Cleave Law Firm carefully assess your case to determine if it has merit and is therefore worth pursuing. After accepting your case, we help you file your lawsuit and perform an immediate and thorough investigation to gather evidence to substantiate your claim.

Mississippi’s dram shop law

Mississippi law grants immunity from liability for people who lawfully sell or serve intoxicating drinks. Yet bars, restaurants, taverns and other venues that serve alcohol can be held liable for financial damages caused by accidents that result from serving a visibly intoxicated patron. For example, if a man is clearly drunk and served alcohol at a bar and later causes a car crash, the bar may be partially liable for the accident. In both dram shop and social host cases, winning entails proving the defendant was visibly intoxicated when served by the host. To establish the defendant was, in fact, visibly drunk, our attorneys examine credit card statements, bar tabs and bills and talk to eyewitnesses. Typically, people are considered visibly intoxicated when they exhibit:

  • Trouble standing
  • Slurred speech
  • Bloodshot eyes
  • Nausea or vomiting

Whether you suffer injury because of an alcohol-related boating accident or because of a drunk or drugged truck driver, competent legal counsel can help you seek justice. Skilled accident attorneys can review your case and help you recover the maximum damages from all parties at fault.

Criminal penalties for drunk drivers

State law punishes first-time drunk drivers with a 90-day license suspension, up to 48 hours in jail and $1,000 in fines. With each subsequent offense, the penalties increase substantially — a third offense is punishable by up to five years in prison. Furthermore, a driver who causes an accident while intoxicated by drugs may face additional charges, including drug possession.
