No one can adequately describe the pain of losing a loved one. However, if another person or party is responsible, your family deserves justice. Since 1926, Corban • Gunn • Van Cleave Law Firm has represented wrongful death survivors in Mississippi.

While no amount of legal action can bring your loved one back, you may be able to recover damages to help with medical expenses, pain and suffering, funeral costs and other losses. A wrongful death claim is a serious matter. We help clients with car accident cases, oil rig accidents and many other types of fatal accidents, so our firm thoroughly understands the legal entanglements involved. After assessing your case, we determine the best route for you to take to help your family secure just compensation.

What is a wrongful death claim?

A wrongful death claim is a civil lawsuit brought against a defendant who caused a death through negligence. However, there are certain requirements as to who may file a claim. In Mississippi, the following individuals may file a wrongful death lawsuit:

  • The widow or widower of the deceased husband or wife
  • The parent of the deceased child or the child of the deceased parent
  • A sibling of the deceased

Types of wrongful death cases

A wrongful death can occur almost anywhere, but many such deaths happen in motor vehicle accidents. At Corban • Gunn • Van Cleave Law Firm, we assist clients who lose loved ones in many different types of accidents, ranging from oil rig accidents to medical malpractice. Our attorneys thoroughly investigate your case to determine the party or parties responsible. If an unsafe product turns out to be the cause of your loved one’s death, our aggressive legal team seeks to recover damages from the product’s manufacturer.

Statute of limitations

A wrongful death action must be brought within three years of the date of death. If your loved one was killed by assault and battery, a claim must be brought within one year. Failure to file within the statute of limitations may prohibit recovery of damages.

Types of damages

A successful wrongful death lawsuit can provide your family with rightful compensation. The types of damages you receive vary based on the circumstances of your case. You may be able to obtain compensation for the following:

  • Loss of anticipated future earnings
  • Loss of benefits, such as a pension or retirement benefits
  • Medical bills and funeral costs
  • The victim’s pain and suffering
  • Mental anguish and emotional distress
  • Loss of companionship, love, care or protection
  • Loss of inheritance
  • Punitive damages
